View Full Version : The Japanese Justice System; seriously flawed

In the JUBot news we were discussing how to avoid being arrested , tried, and convicted in Japan, sparked from the news about an American step-dad not confessing and that ending the police's investigation of the man.
As I said, and it is no secret within Japan, police work and convictions rest on coercion during the interrogation and confession. Avoid confessing, and you can probably avoid jail time. Confess, then your fate is virtually sealed. Another timely story on the point just came out today:
Retrial opens to clear man wrongfully convicted of rape

The retrial to prove the innocence of a 40-year-old man who was imprisoned after being wrongfully found guilty of rape and attempted rape, opened Wednesday at the Toyama District Court Takaoka branch. ...
The defense counsel also made a statement and severely criticized the faulty investigation, saying: "By prejudging the defendant as the assailant, [the police] arrested and detained him and, after a long, coercive interrogation, forced the man to make a fictitious confession and falsely charged him as a criminal."

I hate the way GoJ does thing. I mean I guess since i've lived somewhere else all my life it seems stupid to me. But its probably seem like the way things are done in Japan to locals. My opinion.

I don't mind it so much. Heck, it's better than murdering over 250 people, then realizing later through DNA that it was a mistake.
This is an over-simplification of the Japanese judicial process. Did the step dad get convicted by ensuing legal agencies? Obviously, he was guilty because he has not proven his innocence after all?

This justice system at least from my point seems effective in detterence compared to the U.S.

A buddy of mine was brought in because one of the cameras on 329 cought him speeding... I can see the justice in that... nice work boys... but on the flip side... there should be a set amount that you have to pay according to how fast you were going, which there is. The thing that got me about the whole thing was that he had to pay double because he said that he knew how fast he was going. So this meant that he willingly and knowfully broke the law. That that is some bs right there...

Hey, I got a secret for all those with speeding ticket woes. It's really easy and it will help you avoid getting a ticket. DON'T SPEED!!!! Honestly, it's as simple as that. You don't need to do 120 clicks in a 60. If you get caught for it, don't bitch, you knew what you were doing.

Before the revision there was a 3 tier system. There was the military MP's, GRI police and the local cops. The local cops had no jurisdiction over you. The GRI police could detain you and call the MP's. The MP's could arrest you.

Maybe there is a set amount, we just don't see it until we admit to wrongdoing. Voluntary and involuntary actions, meditated and pre-meditated planning all carry differing penalities.
I was busted by a camera on 58. Had no problem paying the entire fine (80k yen) with an immense sense of humility and regret.
We may not be privy to all of the codes that apply to us when we admit that we've willingly done something.

But, I can say with all honesty, I hate the Orwellian creep of cameras into our lives.
Perhaps you should have just sent them a photo of the fine money taken by your camera.

That is some pretty weird stuff right there......geez, how long would it take the public to figure out what "not" to say when they ask you if you knew your speed.
Funny, it kinda reminds me of the DMV system here in CA....when you buy a used car, they ask how much you paid for it, and charge sales tax accordingly. Guess how many people "only paid $150" for their used car? Talk about motivation to lie!
