They are illegal? Just on base? I have a couple to keep the cats out of my trash, or a quick shootout with the girlfriend.

Pacific bases aim to curb spread of replica firearms
By Vince Little, Stars and Stripes
Pacific edition, Sunday, March 21, 2004

U.S. military officials in the Pacific are taking aim at the proliferation of Airsoft guns and accessories, exact replicas of actual firearms that fire hard, plastic pellets using springs, carbon-dioxide charges and electricity. A few high-end pistols, shotguns, machine guns and assault rifles feature fully functioning spotlights, magazine releases, scopes and silencers — and sell for as much as $2,000. Some even carry a fabricated U.S. government seal.

Following a rash of recent confiscations at some installations, officials are reminding base communities that the guns are prohibited by U.S. Forces Japan and may not be possessed by servicemembers, U.S. civilians or family members.

Punishment: Case by case
Consequences for violators of the Airsoft policy vary: Military members may be referred to their commanders or be subject to the Uniform Code of Military Justice, while punishments for family members range from a possible verbal warning for a first-time adolescent offender to the return of a family member to the United States for multiple infractions or injury inflicted on a victim, said Marine 1st Lt. Al Eskalis, a Marine Corps spokesman.

For most civilian offenders, it almost always depends on the incident’s severity, and possession alone won’t lead to expulsion from the base, added Scott Fandrey, who manages the Yokota Conduct Adjudication Program.

“Now if you shot someone in the eye, all sorts of charges are going to be thrown at you,” he said. “But if you’re talking strictly possession and not use of the weapon, you won’t be talking about debarment from the base.

“It’s taken on a case-by-case basis. Actions range from community service to suspension of commissary, AAFES and MWR privileges to debarment.”

Similar adjudication is dished out at Misawa.

“Violators are charged with a community-standard violation,” said Maj. Joseph Milner, commander of the 35th Security Forces Squadron at Misawa Air Base. “If they are active duty, that amounts to a violation of Article 92 of the UCMJ, and punishment is left to individual commanders. If they are dependents, the case will be reviewed by the Family Member Misconduct Board.”

According to Chip Steitz, an 18th Wing spokesman, off-base offenses could be referred to Japanese authorities for possible investigation and indictment. If indicted for a serious offense against a Japanese citizen, the family member will face trial in Japanese court.

On Atsugi, depending on where the weapons are confiscated, personnel may face up to a year suspension from school, security officer Ensign Anthony Brown said, or base contractors can lose their employment privileges. But the punishment ultimately remains at the commander’s discretion.

“These weapons are banned because they look identical to the real ones,” he said. “From handguns to shotguns, it’s impossible to tell the difference at first glance. Sometimes, a momentary glance is all security personnel get when making life or death decisions. Furthermore, some of the rounds for the shotguns are almost identical to the rounds that are actually used.”

Officials also tout amnesty programs as an avenue for keeping the weapons off military installations.

“If someone comes in and turns in a pellet gun, we will not charge them,” said Senior Airman Joseph Null, Yokota’s crime prevention manager. “They can do so with amnesty. Unless, of course, they shoot somebody with it. Then, that’s not going to work out.”
