Admitted hospital rapist is found ‘not guilty’ by Naha Chief Justice

Date Posted: 2008-11-21

The man admitted he entered a female patient’s room at one of Naha City’s mental hospitals a few months ago and raped her while she slept, but the Chief Justice of the Naha City District Court has found the man not guilty.

The Chief Justice ruled the 43-year-old man is mentally sick and has epilepsy, and couldn’t control himself, saying “he just lost the mind and body.” The judge’s ruling came after hearing conflicting interpretations of the man’s condition from the Naha Prosecutor’s Office and a District Court statement.

One set of psychiatric tests, the prosecutor’s office said, “indicated the man should stay at this mental hospital.” The Naha District Court said, however, “He just has a weak mind and can’t control himself. He doesn’t need to stay at the hospital.”

The Prosecutor’s Office is reevaluating the decision, and the Naha District Court now admits “he might have mental sickness, not only a weak mind control. We have to think more carefully.” For now, though, the man has been ruled innocent of the rape.
