Court rules truck driver at fault in 2004 fatal accident

A truck driver has been ordered to pay ¥30 million in damages for actions in a 2004 fatal accident on Highway 58 near Onna Village.
Reversing an earlier ruling, the Naha District Court found the truck driver at fault for crashing into a passenger car in the Seragaki area, accepting the family’s argument police reports of the accident investigation were inaccurate. The driver of the car died in the accident, while the truck driver was uninjured.
The truck driver had argued the passenger car was parked alongside the road, then suddenly tried to make a U-turn on the road, driving into the path of his truck. The family and the court disagreed, calling the truck driver’s actions wrong. In fact, the court decided, the truck driver had been illegally trying to pass the car in a no-passing area, striking the automobile.
The family had conducted its own investigation and pressed for court action after it disputed the police investigation results, which had found the driver’s story plausible.
