Transportation company settles overtime pay dispute

Date Posted: 2008-01-21

A two-year court battle over whether Hokugan Transportation Company had to pay its workers overtime has ended, with the court ordering the company to pay.
Hokugan, which had asked its workers to accept contract status instead of regular company positions, refused to pay the 28 employees overtime for their work delivering bentou foods to convenience stores. The company ordered workers to make deliveries night and day, whenever they had a purchase, but never paid overtime.
The Fukuoka High Court’s Naha Branch ruled the company was wrong, and ordered it to pay the workers ¥47 million overtime pay, plus another ¥17.3 million for damages. “The company has to pay overtime work pay to workers,” the court ruled, noting the Naha District Court had ordered Hokugan to comply with overtime payments a year ago.
