DUI & DWI penalties hefty with revised Traffic Law

Drinking after driving now packs an even heavier set of penalties with implementation of Japanís Amended Traffic Law, which extends the long arm of the law even to those serving the drunk driver or riding in a vehicle with him.

The new law roared into effect September 1st, doubling the fines and increasing jail time for those Driving Under the Influence, and significantly boosting jail time and the financial penalty for those Driving While Impaired. The blood alcohol levels set for measuring those Driving While Impaired is 0.03, while itís 0.05 for Driving Under the Influence.

Lawmakers added three new legal categories to the Traffic Law: Providing an intoxicated person with a vehicle, Providing a person with alcohol who subsequently is found DUI or DWI, and Riding as passengers in a vehicle operated by a person intoxicated.

The penalty for refusing a balloon test was increased from the current •300,000 to new limits of three months confinement or a fine not exceeding •500,000. Hit & Run incidents are now more severely punished, with fines and prison time doubling to confinement not exceeding 10 years and a fine of up to •1 million.

The current and new laws and punishments are:

Driving Under the Influence (DUI)
Current: Confinement of up to one year or fine not exceeding •500,000
New: Confinement up to three years and fine up to •1 million

Driving While Impaired (DWI)
Current: Confinement not exceeding one year or fine up to •300,000
New: Confinement up to three years or fine not exceeding •500,000

Providing an intoxicated person with a vehicle (New Law)
DUI: Confinement up to five years or fine up to •1 million
DWI: Confinement up to three years or fine not exceeding •500,000

Providing an intoxicated person with alcohol who subsequently DUI or DWI (New Law)
DUI: Confinement up to three years or fine up to •500,000
DWI: Confinement up to two years or fine not exceeding •300,000

Riding as passengers in a vehicle operated by an intoxicated person (New Law)
DUI: Confinement up to three years or fine up to •500,000
DWI: Confinement up to two years or fine not exceeding •300,000
