Contractor, Ogimi Village at odds over contract validity

Ogimi Village wants control of its lime processing Industry Production Facility, and has chosen a new company to operate it.
The contractor chosen in 2005, Operation Trust Company, says they’ve fulfilled terms of the contract and refuse to hand over the facility. Ogimi Village had a one-year contract with Operation Trust Company, and claims it has the right to decide what company now gets the work. The village has asked the former contractor to vacate the lime processing plant and turn the facility back over to village officials.
Rei Yonaha formed the Ogimi Industrial Promotion Committee Company to operate the lime processing facility for the Village, but now says municipal rules have been amended, and the Village Assembly has chosen another company.
Operation Trust Company says it has done the work, and won’t give over the plant. “We don’t have any problems,” a spokesman says, “so the village should not release the contract and we’re not delivering the facility to it.” The village insists “Operation Trust was just a temporary contract move until the municipality set its rules. It was just a temporary measure.”
Yonaha says “I thought I’m the one going to get the assignment to operate the facility, because of our trust for each other.” Ogimi Village’s lawyer explains the circumstances differently. “Why would the village choose a company that isn’t a professional lime maker,” he said. “It’s just a small, private company that doesn’t even have a legal incorporation.”
