Homeless man sentenced to prison for indecent assault

Naha District Court handed down a prison sentence to a 50-year-old homeless and workless man who was accused of sexually assaulting a 5-year-old girl in a park in Naha City in November.

According to prosecution, the man had approached the little girl who was playing alone, and offered her candy and soft drink. He then took the girl behind a rock, tore off her underwear and started groping her. The girlís grandmother who had come to look for the girl saw the man and the girl and immediately called the police who arrested the man. According to police documents the man had confessed to groping the girl.

The defense lawyers argued that the grandmotherís testimony could not be trusted as there was no physical evidence that the man had actually touched the girl. They argued that the man had confessed under pressure from the police who had threatened to jail him for life if he did not admit his guilt.

The prosecutors argued successfully that the grandmother could not have concocted the story in such great detail. They pointed out that the woman had repeatedly confirmed every single point during the police investigation.

The court agreed and sentenced the man to one year and six months in prison. The defense plans to take the case to a higher court.
