Awase tesidents’ fight for sunshine heading for courts

A second group of angry homeowners in Awase, Okinawa City, are heading for courts in their battle against construction of a high-rise apartment building in the midst of their single homes.

In February, a group of 15 homeowners in the area took the same construction company to the court in order to force a stop to the construction of the high-rise. That case is still pending.

The six residents who are behind the new court battle claim that when they bought their homes, they did so with understanding that no building in the area would be higher than three floors.

“When we were considering buying this house, the salesperson assured us that no building would be higher than three floors in this area. Now they are building that monster next to us that is going to block most of the sunlight. Besides, the construction work is damaging our house as I have noticed several cracks in it since the work began,” an angry resident said.

The residents are asking ¥55 million in compensation from the developer.

The lawyer representing the developer says that any damage to existing houses is news to him. “We have asked residents to tell us if they have any damage, and we would be there right away for repairs,” the lawyer said. He also maintains that the company has all required permits for construction of the high-rise.

The construction company president maintains that no promises were ever made concerning the height of the future buildings in the area. “I have never heard that anyone made promises to residents. We also have all required construction permits for this building,” the president stated.
