Government, plaintiffs agree to finish noise suit

Date Posted: 1998-06-13

Government lawyers took local officials and representatives of citizens' groups seeking compensation for noise pollution caused by operations on Kadena Air Base, by surprise when they announced that the government would not appeal to the highest court the decision made by the Kyushu High Court. The court awarded monetary compensation to the plaintiffs, but refused their demand for an order to stop nigh flights on the base on the basis that the court has no jurisdiction.

The decision was handed over Jun. 4, and although the plaintiffs had most mixed feelings about it, they also quickly announced that they wouldn't appeal either.

"I was sure that the government would appeal and our struggle would go on. I feel like I have been rewarded for our 16-year struggle, but at the same time, the court decision means that the roar of the jets on base will continue," Chatan Mayor Choichi Hentona said after the ruling.
