Couple Sues Hospital Over Dead Baby

Ryukyu University Hospital has lost a case at Naha district court brought by a couple whose baby died as a result of the birth procedure she was advised to follow at the hospital.

The couple lost their baby in April 1992 because of a bad decision by the doctor who was tending the woman while she was in labor. The doctor suggested she use a drug to stimulate her labor but he did not explain the possible side effects of the medicine. Although the woman did not want to use the drug she accepted the doctor’s suggestion and then had an abnormal reaction to the medication. Afterwards the doctor performed a Caesarian operation on her with the result that her uterus ruptured. The baby was removed from the uterus, but with a damaged brain. Two years later the baby died.

The judge said in court on Tuesday “the doctor could have chosen a natural birth method. Also he should have explained the side effects of the drug.” The couple were asking for damages of ¥51.6 million.
