Man fired for “horseplay” wins ¥3.5m

A worker fired from his job at an Osato home for the aged in January last year, won the lawsuit he had brought to Naha District Court.

The court ruled that the dismissal was without sufficient cause, and ordered the facility to pay ¥3.59 million as lost wages. The old people’s home immediately filed and appeal to the higher court. The management claims they had observed the man several times to engage in what they considered dangerous play with patients at the home.

Specifically they said the man had pulled a plastic bag over the heads of patients. The man admitted the charge, but said that it was just play and the patients had seemed to enjoy such horseplay.
