Prosecutor, defense argue accidental homicide case

The Naha District Prosecutor is demanding 78-year-old Chiyoko Nakamura be sentenced to two years in prison for killing an elementary schoolgirl last August, but her defense lawyer is contending it was really an accident and that a judgment should be set aside.

The girl was killed in Tomigusuku City after being hit by Nakamura's car. The defense says "Chiyoko did not have recognition of the accident resulting in injury or death." The prosecution disagreed in court, pointing out that the accident spot was on an open road that Nakamura could have stopped on if she'd had her eyes focused on the road.

Nakamura's attorneys are also asking the judge to toss out the hit-and-run charge because, they say, their client had never caused an accident until now." They also said that Nakamura, even if she'd heard crash sounds, "didn't recognize the crashモ because she assumed it was mischief. The court will rule on the case in the term later this month.
