Trial to decide liability in motorcycle death

Date Posted: 2010-06-17

The cause behind the death of a boy in a 2008 motorcycle accident in Tomishiro City’s Senaga Island area is being debated in court, with prosecutors accusing the motorcycle driver of negligence that killed his friend.

The trial at Naha District Court has prosecutors alleging the boy thrown from the motorcycle and died was caused by the “the driver’s failure to look ahead properly and speeded up the motorcycle, causing the accident to happen.” The dead youth was riding behind the driver as a passenger on the motorcycle. The driver on trial, who faces conviction for not properly maintaining control of the motorcycle, tells a different story about what caused the motorcycle to careen out of control and strike a stone curb.

“I didn’t speed up and I didn’t fail to look ahead at the road,” he told the court. He says his friend moved. “therefore my motorcycle went out of control, I lost my balance and crashed into the curb.”

The victim’s parents were in court as the trial opened, listening to testimony about the accident, which took place in darkness about 9 p.m. They heard the motorcycle driver explain how he tried to brake just before reaching the curb at a speed of 40kph or more, but said he was just too late.
